Understanding the New Alien Registration Requirement in the U.S.
KW
In January 2025, a significant update to U.S. immigration policy was introduced through Executive Order 14159, titled Protecting the American People Against Invasion. This directive reinforces the long-standing requirement under Section 262 of the Immigration and Nationality Act (INA) that all non-citizens (aliens) residing in the United States for 30 days or more must register with the federal government.

Who Must Register?
The registration requirement applies to:
- All aliens aged 14 or older who were not registered and fingerprinted during their visa application process.
- Parents or legal guardians of aliens under 14 must ensure those minors are registered.
- Aliens who turn 14 must re-register and be fingerprinted within 30 days of their birthday.
What Does Registration Involve?
The process includes submitting biographic information on Form G-325R and undergoing fingerprinting (unless waived). Once completed, the Department of Homeland Security (DHS) issues a registration document. Aliens aged 18 and older are legally required to carry this document at all times.
What Happens If You Don’t Register?
Failure to comply with the registration requirement can lead to serious consequences, including:
- Civil and criminal penalties;
- Misdemeanor prosecution;
- Fines; and
- Possible incarceration.

How to Register with USCIS
To streamline compliance, USCIS has introduced Form G-325R, Biographic Information (Registration) which can be filed online after creating a USCIS Online Account. This form can be completed online, and USCIS provides a helpful Alien Registration Requirement Determination Tool to guide individuals in determining whether they need to register.
Important Clarification
It’s crucial to understand that registration does not:
- Grant valid immigration status
- Authorize US employment
- Provide any legal benefit under U.S. immigration law
It is purely a compliance measure to ensure the government maintains accurate records of non-citizens residing in the country.
Final Thoughts
With these changes, it’s more important than ever for non-citizens in the U.S. to stay informed and compliant. If you're unsure whether you need to register, visit the USCIS Alien Registration Requirement page and use the determination tool provided.
