U Visa Services (Victims of Crime)
Justice and Protection for Immigrant Crime Victims
The U visa offers immigration protection to noncitizens who have suffered substantial mental or physical abuse as victims of certain crimes and who are willing to assist law enforcement or government officials in the investigation or prosecution. KW Immigration Law PC provides compassionate, experienced legal representation for survivors navigating this crucial humanitarian pathway.
Who Qualifies for a U Visa?
- Victims of qualifying criminal activity (e.g., domestic violence, sexual assault, trafficking, stalking, kidnapping, and more)
- Suffered substantial physical or mental abuse as a result of the crime
- Possess information about the criminal activity
- Are helpful, have been helpful, or are likely to be helpful to law enforcement in the investigation or prosecution
- The crime occurred in the U.S. or violated U.S. law
Our U Visa Legal Services Include:
- Confidential case evaluations and eligibility screening
- Preparation and filing of Form I-918, including personal declarations
- Obtaining and submitting the required law enforcement certification (Form I-918B)
- Filing for eligible family members (derivative U visas)
- Adjustment of status to lawful permanent residence (Green Card) after three years in U status
Important Considerations:
- U visas are subject to an annual cap of 10,000 principal visas, but applicants can receive deferred action and work permits while waiting
- Spouses, children, parents (if victim is under 21), and certain siblings may qualify as derivatives
- U visa applicants may also be eligible for waivers of inadmissibility, including unlawful presence or prior deportations
Tips for U Visa Applicants:
- Document all instances of harm, trauma, and interaction with law enforcement
- Cooperate with investigations when safe and possible to do so
- Maintain consistency in personal statements and supporting evidence
- Seek trauma-informed legal assistance to support your mental and emotional well-being
